ASSUMPTION OF RISK, RELEASE, AND WAIVER
Read this section carefully. It affects your legal rights.
WHO IS SIGNING. I am the parent or legal guardian of the player named on this registration ("my player"), and I have legal authority to sign this agreement on my player's behalf and on my own behalf. Under Minnesota law, an agreement of this kind may be signed by a person authorized to accept it on behalf of a minor.
INHERENT RISKS. I understand that fastpitch softball and hitting instruction involve risks that cannot be eliminated no matter how carefully the program is run. These risks include, without limitation: being struck by a batted, thrown, pitched, or deflected ball; being struck by a bat, including a thrown or released bat; contact with netting, cages, screens, turf, walls, flooring, or other facility equipment; slips, trips, and falls; collisions with other participants, coaches, or bystanders; strains, sprains, overuse injuries, fractures, dental and eye injuries, concussion and other head injuries; aggravation of a pre-existing condition; and, in rare circumstances, catastrophic injury, permanent disability, or death. I understand these risks are inherent in the activity, that they exist even when the program is conducted properly, and that my player's participation is entirely voluntary. Knowing this, I choose to have my player participate.
FITNESS AND EQUIPMENT. I confirm that my player is physically able to participate, and that I have disclosed on this registration any medical condition, allergy, injury, or limitation that JCJ Athletics should know about. I am responsible for providing my player with appropriate equipment, including a bat, a batting helmet, and clean indoor athletic shoes, and for ensuring that equipment is in safe condition.
RELEASE, LIMITED TO ORDINARY NEGLIGENCE. In exchange for my player being allowed to participate, I release and agree not to sue JCJ Athletics, its directors, officers, employees, coaches, instructors, and volunteers (together, "the Released Parties") for claims arising out of my player's participation in the program, to the extent those claims result from the inherent risks of the activity or from the Released Parties' ordinary negligence.
WHAT THIS RELEASE DOES NOT COVER. This release does NOT apply to, and I am NOT releasing, any claim arising from conduct that is greater than ordinary negligence, including gross negligence or willful, wanton, reckless, or intentional misconduct. Minnesota law makes any attempt to waive such claims void, and no part of this agreement should be read as attempting to do so.
SEVERABILITY. If any part of this agreement is found to be unenforceable, that part is severed and the remainder, including the release of claims for ordinary negligence and for risks inherent in the activity, remains in full force.
FACILITY. The Cages is an independent facility not owned or operated by JCJ Athletics. This agreement covers the Released Parties named above. Use of the facility may also be subject to that facility's own rules and agreements.
EMERGENCY MEDICAL CARE. If my player is injured and I cannot be reached, I authorize JCJ Athletics to seek emergency medical care for my player, and I accept financial responsibility for the cost of that care. I confirm that the emergency contact information on this registration is accurate.
PROGRAM RULES AND REMOVAL. I agree that my player will follow the instructions of program coaches and the rules of the facility. JCJ Athletics may remove a participant from a session or from the program for conduct that endangers that participant or others. No refund is due in that circumstance.
GOVERNING LAW. This agreement is governed by the laws of the State of Minnesota.
MY ACKNOWLEDGEMENT. I have read this agreement. I understand that I am giving up substantial legal rights, including the right to sue the Released Parties for claims arising from the inherent risks of the activity and from their ordinary negligence. I am signing it freely and voluntarily, and not in reliance on any statement outside this document.
